These Terms of Service (hereinafter "Terms") define the rules for using the platform talentboardbarcelona.com (hereinafter "Platform"). They are accompanied by a detailed privacy policy, which explains how we process your personal data in accordance with the General Data Protection Regulation (GDPR). By registering on our Platform, you accept:

1.2. Definitions

For the purposes of these Terms of Service, the following terms shall have the following meanings:

  • Platform: refers to the website accessible at talentboardbarcelona.com, operated by La French Tech Barcelona.
  • Talent: any natural person registered on the Platform individually, for the purpose of professional networking.
  • Company: any legal entity or natural person acting in a professional capacity, registered on the Platform to view talent profiles.
  • User: any person accessing the Platform, whether Talent or Company.
  • Account: personal space created by a User during registration on the Platform.
  • Services: all functionalities made available by the Platform, including profile creation, profile consultation, and networking.
  • Personal data: any information allowing direct or indirect identification of a User, within the meaning of the GDPR.
  • Networking: action allowing Talents and Companies to come into contact via the Platform.

2. Platform Access and Service Availability

2.1. Platform Access

Access to the site implies acceptance of these terms. Talents and companies undertake to provide accurate, complete, and up-to-date information during registration. You are responsible for the confidentiality of your login credentials and for any activity carried out under your account. You undertake to immediately notify La French Tech Barcelona of any unauthorized access to your account. The Platform is reserved for persons of legal age or with the legal capacity to contract.

2.2. Service Availability and Maintenance

The Platform is accessible in principle 24/7. However, La French Tech Barcelona reserves the right to suspend, limit, or interrupt access to all or part of the Platform, particularly for maintenance, update, security reasons, or in case of technical incident. La French Tech Barcelona does not guarantee continuous or error-free availability of the Platform and cannot be held responsible for any temporary interruption of the service, whatever the cause. No compensation may be claimed for this reason.

3. Services Offered and Platform Role

3.1. Services Offered

  • Creation and management of a professional profile
  • Profile visibility to partner companies registered on the Platform
  • Direct networking with recruiters
  • Access to job opportunities matching your profile
  • Receipt of notifications regarding relevant opportunities

For companies:

  • Access to the registered talent database that has consented to sharing their data
  • Consultation of candidate profiles
  • Direct networking with interesting talents
  • Possibility to contact candidates via the Platform

Important: No guarantee of employment or recruitment is provided. The Platform acts solely as an intermediary for networking.

3.2. Platform Status and Absence of Contractual Relationship

The Platform acts exclusively as a technical intermediary for networking between Talents and Companies. La French Tech Barcelona is neither an employer, recruiter, placement agency, nor agent of any party. It does not intervene at any time in the selection, recruitment, negotiation, or conclusion of contracts between Talents and Companies. Use of the Platform does not create any contractual, employment, pre-contractual, or subordination relationship between La French Tech Barcelona and Users, nor between Talents and Companies. Any professional, contractual, or pre-contractual relationship concluded following networking is the sole responsibility of Talents and Companies.

4. User Obligations and Prohibited Uses

4.1. General Obligations

All users undertake to:

  • Provide accurate, complete, and up-to-date information
  • Respect applicable laws and the rights of others
  • Not use the Platform for illegal, discriminatory, or unethical purposes
  • Not harass, threaten, or offend other users
  • Not scrape, massively download, or copy the database
  • Not share other users' data without authorization
  • Respect the confidentiality of non-selected candidates. Any false, offensive, discriminatory, or illegal content may result in suspension or deletion of the account without notice.

4.2. Prohibition of Automated Use and Data Exploitation

It is strictly prohibited to use the Platform by means of automated scripts, robots, extraction tools, scraping software, or any automated device, including for artificial intelligence purposes. It is also prohibited to:

  • Train or feed AI models from Platform data,
  • Export, resell, enrich, or exploit data for external purposes,
  • Create a derived database, total or partial. Any violation will result in immediate suspension or deletion of the account, without notice, and may lead to legal action.

5. Personal Data and Consent

5.1. Explicit Consent for Talents

During registration, you must check the following statement to activate your account: ☑ I accept that my personal data be processed for networking with companies, that my profile be visible to partner recruiters, and I authorize companies to contact me directly. Without this explicit validation, no account can be activated and your profile will not be visible to companies. You can modify or withdraw this consent at any time by accessing your privacy settings or by contacting contact@frenchtechbarcelona.com.

5.2. Explicit Consent for Companies

By registering as a Company, you consent to:

  • Access to the talent database and directory of registered talents who have consented to sharing their data
  • Collection of your professional contact data for subscription management purposes
  • Recording of your profile consultation history as a compliance trace
  • Use of your email address for information relating to your account, recruitment alerts, and service-related communications. You have the right to:
  • Unsubscribe at any time
  • Request access to your data
  • Request deletion of your account

5.3. Absence of Consent

Talents appear on the Platform only with their explicit consent. If you discover that your profile appears on our platform without your consent:

  • Please inform us immediately by email at contact@frenchtechbarcelona.com
  • Your profile will be deleted within 24-48 hours
  • You have the right to request permanent deletion of all your data
  • You may contact the competent supervisory authority for GDPR violation. The request must allow identification of the profile concerned.

5.4. Responsibility Regarding Unauthorized Sharing

If a company contacts a talent using data obtained unfairly (outside the Platform), that company is responsible to the talent. La French Tech Barcelona will not be responsible for data misuse by companies for other purposes. However, we undertake to:

  • Document all profile accesses
  • Monitor abnormal behaviors
  • Remove access from any company violating the rules
  • Cooperate with supervisory authorities in case of investigation

6. Security, Electronic Evidence and Data Retention

6.1. Electronic Evidence

Computer records, connection logs, access histories, traceability data, and electronic records kept by the Platform constitute valid evidence of actions performed by Users. These elements may be produced as evidence in case of dispute, claim, or control by a competent authority.

6.2. Data Retention Period

  • During active registration: Profile kept as long as the talent wishes
  • After account deletion: Complete deletion of personal data within 30 days (except legal obligation)
  • Non-users for 24 months: Inactive talents will receive an email inviting them to renew their consent. Otherwise, the account will be deactivated and data archived then deleted after 2 additional months

For companies:

  • Data kept during the subscription period
  • Complete deletion 6 months after account termination

  • Maximum retention of 12 months for security purposes

7. Liability and Limitation

7.1. Platform Liability

La French Tech Barcelona provides the Platform "as is" without express or implied warranty regarding:

  • Obtaining employment or hiring
  • Quality of candidates or offers
  • Absence of interruption or errors
  • Absolute security of data. The Platform acts solely as an intermediary facilitating networking. Users acknowledge that the success of networking depends on external factors beyond the control of La French Tech Barcelona.

7.2. Limitation of Liability

La French Tech Barcelona's liability may in no case be engaged for indirect, immaterial, or consequential damages, including loss of opportunity, loss of revenue, loss of professional opportunities, damage to image or reputation. In any event, and within the limits authorized by applicable law, La French Tech Barcelona's total liability is strictly limited to the amount possibly paid by the Company for use of the Platform during the twelve (12) months preceding the event giving rise to the damage, or to zero (0) euros when access to Services is free.

7.3. Guarantee and Indemnification by the User

The User, and in particular the Company, is solely responsible for the use it makes of data, information, and profiles accessible via the Platform, including outside of it. The Company guarantees and indemnifies La French Tech Barcelona against any claim, complaint, action, sanction, damage, loss, cost, or expense (including legal fees and attorney fees) resulting from:

  • Use of Talent data non-compliant with these Terms,
  • Use of data outside the professional networking purposes provided,
  • Contact or processing of data carried out without a valid legal basis,
  • More generally, any violation of applicable legal or regulatory obligations, particularly regarding personal data protection. This guarantee covers in particular claims made by Talents, supervisory authorities, or any third party, insofar as the event is attributable to the User.

8. Intellectual Property, Exploitation and Communication

8.1. Intellectual Property

Intellectual property rights relating to the Platform, its architecture, code, database, and functionalities are held by their respective holders. La French Tech Barcelona has the right to exploit the Platform within the framework of its mission to animate and operate the TalentBoard Barcelona service.

8.2. Use of Company Logos and Trademarks

By registering on the Platform, the Company expressly authorizes La French Tech Barcelona to use free of charge its name, corporate name, trademark, and logo, exclusively for the purpose of presenting the Company as a user or partner of the Platform. This use may in particular occur on the site's homepage, digital communication materials, institutional presentations, or any promotional material related to the Platform, without implying a commercial partnership or approval. This authorization is granted on a non-exclusive basis and for the duration of the Company's registration. The Company may request removal of its logo at any time by simple written request. This authorization is subject to explicit acceptance during the registration process.

8.3. Platform Exploitation and Evolution

La French Tech Barcelona operates the TalentBoard Barcelona Platform under a right of use and exploitation. The operation of the Platform may be transferred, entrusted, or granted to any other entity, without this affecting the rights and obligations of Users under these Terms.

9. Suspension, Termination and Force Majeure

9.1. Account Suspension or Deletion

La French Tech Barcelona reserves the right to suspend or delete any account in case of:

  • Violation of these Terms
  • Provision of inaccurate or fraudulent information
  • Abusive, harassing, or discriminatory behavior
  • Attempt to scrape or unauthorized access
  • Use for illegal purposes. In case of serious violation, deletion may be carried out without notice.

9.2. Discretionary Termination

La French Tech Barcelona reserves the right to suspend or delete, at any time, any User account, at its sole discretion, without obligation of justification, notice, or compensation, in particular to preserve the security, integrity, or compliance of the Platform.

9.3. Modifications to Terms

La French Tech Barcelona may modify these Terms at any time. Modifications will be displayed on this page with the update date. Continued use of the Platform after publication of modifications constitutes acceptance of these changes.

9.4. Service and Business Model Evolution

La French Tech Barcelona reserves the right to evolve the Services offered, as well as to introduce, at any time, paid features or services. Applicable financial conditions will be subject to specific information and, if applicable, separate acceptance.

9.5. Force Majeure

La French Tech Barcelona cannot be held responsible for any failure resulting from a force majeure event, as defined by the jurisprudence of competent courts, including in particular major breakdowns, cyberattacks, administrative decisions, strikes, or unpredictable events independent of its will.

10. Final Provisions

10.1. Applicable Law and Jurisdiction

These Terms of Service are governed by Spanish legislation and the General Data Protection Regulation (GDPR) of the European Union. Any dispute will be submitted to the competent jurisdiction in Spain.

10.3. Independence of Clauses

If one of the stipulations of these Terms were declared null or inapplicable, the other provisions would retain all their force and scope.

10.4. Language and Interpretation

These Terms are written in French. In case of translation, only the French version shall prevail in case of divergence of interpretation.
